Terms of Service

1. Agreement to Terms

By accessing or using Smart Roster Pro, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. These terms constitute a legally binding agreement between you and Vinh Ngo Gia (sole trader), ABN 97 340 199 407, operating the Smart Roster Pro platform.

2. Description of Service

Smart Roster Pro is a software-as-a-service (SaaS) platform that generates optimised staff rosters for small businesses. You input employee availability, roles, and constraints, and Smart Roster Pro produces schedules that you can export to tools like Deputy, Tanda, or Excel.

3. Account Registration

To use Smart Roster Pro, you must create an account. When registering, you agree to:

• Be at least 18 years of age.
• Provide accurate and complete information.
• Keep your password secure and confidential.
• Be responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorised access to your account.

You may register using an email address and password, or through Google OAuth.

4. Subscription Plans and Billing

Smart Roster Pro offers a free tier and paid subscription plans. Key billing details:

• All prices are displayed in Australian Dollars (AUD).
• Paid plans are billed monthly on a recurring basis.
• Payments are processed securely by Stripe. We do not store your credit card details.
• Subscriptions auto-renew at the end of each billing period unless cancelled.
• You can view current pricing on our pricing page.

5. Free Trial

Paid plans include a 7-day free trial. During the trial, you have full access to all features of the selected plan. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and you will be charged. You may cancel the trial at any time from your dashboard or through the Stripe billing portal.

6. Cancellation

You may cancel your subscription at any time from your dashboard or through the Stripe billing portal. When you cancel, you will retain access to your paid plan features until the end of your current billing period. After that, your account will revert to the free tier.

7. Refund Policy

We offer a 14-day money-back guarantee on all paid plans. If you are not satisfied, request a full refund within 14 days of your first payment. For full details, see our Refund Policy.

This refund policy is in addition to your rights under the Australian Consumer Law. If the service fails to meet a consumer guarantee, you may be entitled to a remedy regardless of this policy.

8. Acceptable Use

You agree not to:

• Use Smart Roster Pro for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the service, other accounts, or our systems.
• Scrape, crawl, or use automated means to extract data from the platform without our written permission.
• Upload or transmit malicious code, viruses, or harmful content.
• Interfere with or disrupt the service, servers, or networks connected to Smart Roster Pro.
• Use the service to store or process illegal content.

9. Intellectual Property

The Smart Roster Pro platform, including its code, design, branding, and documentation, is owned by Vinh Ngo Gia and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the service without our written permission.

10. User Data

You retain full ownership of the data you enter into Smart Roster Pro, including employee information, availability, and generated rosters. We process your data solely to provide the service. You can:

• Export your data at any time using our built-in export features.
• Request a complete copy of your data by emailing us.
• Request deletion of your data at any time.

11. Limitation of Liability

To the maximum extent permitted by law, the total liability of Smart Roster Pro (and its operator) for any claims arising from or relating to the service is limited to the total fees you have paid to us in the 12 months preceding the claim.

12. Service Availability

We use reasonable efforts to keep Smart Roster Pro available and reliable. However, we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. No service level agreement (SLA) is provided for the free tier.

13. Termination

Either party may terminate this agreement:

• You may close your account at any time by contacting us or through your dashboard.
• We may suspend or terminate your account if you violate these terms, with notice where practicable.

Upon termination, you may request an export of your data. We will retain your data for 30 days after account closure to allow for recovery, after which it will be permanently deleted.

14. Governing Law

These terms are governed by the laws of Australia. Any disputes arising from these terms or your use of Smart Roster Pro will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

15. Changes to Terms

We may update these Terms of Service from time to time. If we make material changes, we will provide at least 30 days' notice by email before the changes take effect. Your continued use of Smart Roster Pro after the changes become effective constitutes acceptance of the updated terms.
